The City Council adopted an emergency ordinance amending MMC Chapter 12.40, “City Parks”, Sections 12.40.010 on June 5, 2023.  The ordinance brings the City into compliance with the U.S. Ninth Circuit Court of Appeals decision in Martin v. City of Boise by clarifying that not all City lands are closed to overnight camping or sleeping and declares an emergency to protect public health, safety, and welfare.
