(WASHINGTON, D.C.) - Western Montana Congressman Ryan Zinke voted for H.J. Res. 44, the Congressional Review Act (CRA) that would nullify the Bureau of Alcohol Tobacco, Firearms and Explosives’ (ATF) pistol brace rule the Biden Administration finalized in January 2023.
“Biden and radical democrats in the House are taking every action possible to turn law-abiding Montana gun owners into felons – and I won’t stand for it. The latest attempt from the Biden Administration to erode our Second Amendment right falls right in line with the rest of their anti-Montana agenda,” Zinke said. “I was sent to D.C. to protect our Montana values and way of life against government overreach and unconstitutional regulations. I proudly cosponsored the legislation to overturn the Biden pistol brace ban and I hope my colleagues in the Senate, including Montana’s two U.S. Senators, side with Montana.”
The ATF’s new rule is a pocket ban on the use of a stabilizing brace with a pistol, arguing that the device turns the legal pistol into a short-barreled rifle. The 40 million law-abiding Americans with a brace must now register on a government list or dispose of their firearms. If they don’t comply with this unconstitutional rule, they will become felons, face 10 years in prison and large fines.
Background:
Beginning in 2012, when President Biden was serving as then-President Barack Obama’s Vice President, the ATF had recognized that stabilizing braces serve a legitimate function, and the inclusion of a stabilizing brace on a pistol or other firearm does not automatically subject that firearm to the provisions of the NFA.
